Terms of use for M-TEC documents
The companies of the M-TEC Group focus on service and customer orientation. This also includes the provision of content such as texts, images or video material (hereinafter referred to as ‘materials’). M-TEC grants its partners the defined, restricted rights of use and processing for all these materials for the duration of the cooperation and until further notice.
Rights of use
The materials may be used by the partner exclusively for the purpose of advertising M-TEC products. The rights of use and editing may only be transferred to third parties with the written consent of M-TEC. Copyright remains a non-transferable right of M-TEC and the respective authors. M-TEC is to be cited as the author and source. Any indications of authorship in the materials may not be removed.
Editing rights
The content of the materials may only be edited to the extent absolutely necessary to fulfil the purpose (promotion of M-TEC products) and/or to comply with regional legal requirements. Translation of the materials into the regional language is permitted.
Insofar as the partner’s own services are based on M-TEC texts, graphics or other media forms, the end result must not contradict the materials and statements provided by M-TEC. M-TEC’s CI specifications must not be compromised or violated. M-TEC shall transfer the limited right of use and processing for the specific purpose to the partner for the duration of the cooperation and until further notice. The partner is therefore entitled to use the materials both in an unaltered form and in a form adapted by the partner. For new works based on M-TEC’s advance work, the partner shall subsequently grant M-TEC the unrestricted right to use and process these. The partner is obliged to send all modified, adapted, further developed and translated materials to M-TEC without delay.
M-TEC reserves the right to revoke the granting of the rights of use and processing by giving 4 weeks’ notice to the end of the month. However, if the partner violates these provisions, M-TEC is entitled to revoke the rights of use and processing with immediate effect and without notice. If the licence is revoked, the partner shall no longer be authorised to use and/or process the material. Any material that is the subject of a complaint must be destroyed immediately.
Errors, damage and warranties
The partner shall be liable for any errors that occur during the processing of materials by the partner. M-TEC shall be indemnified and held harmless from all claims arising from such errors. M-TEC shall not be liable for the conformity of the materials with regional legal regulations (country, federal state).
Possible violations of legal regulations in the regional area of the partner (country, federal state, …) are to be checked by the partner. The partner shall be liable for any claims, demands or damages resulting from the materials not complying with regional regulations. M-TEC is also to be indemnified and held harmless in this respect.
